Terms of use of the Amanita e-portal

1. Validity of the contract

1.1. The following terms and conditions of sale (the Terms and Conditions) apply to the use and purchase of the Amanita web environment. (the Terms and Conditions).

1.2. The parties to the agreement are SOLVE ET COAGULA OÜ (registry code 12471354), which operates under the trademark Amanita (Amanita) and the user of the Amanita e-store or, if the user is not registered, the purchaser of the Amanita online environment. (Customer).

1.3. The contract is considered concluded if the Customer presses the “Place Order” button via the Stripe.

 

2. Procedure for payment for goods

2.1. All prices in the Amanita e-shop include 20% VAT.

2.2. The total amount of the order must be paid immediately after the purchase. You can pay using the following methods:

2.2.1. Payment melted upon receipt of the goods.

2.2.2. Payment by Mastercard and Visa credit card or debit credit card via Stripe.

2.3. The price shown before payment includes payment and shipping costs.

2.4. After paying for the order, Amanita will send an order confirmation to the Customer’s e-mail address. No paper invoice will be added to the order. However, if the Customer wishes a paper invoice, the relevant information must be entered in the comments box when submitting the order.

 

3. Delivery of goods and delivery time

3.1. Posting

3.1.1. The order will be posted when the payment has been received in the current account of the owner company Amanita SOLVE ET COAGULA OÜ.

3.1.2. If possible, the ordered goods will be mailed within two (2) working days from the moment of ordering, but not later than within fourteen (14) working days from the receipt of payment.

3.1.3. Goods are not picked up and mailed on weekends and public holidays.

3.1.4. Amanita does not undertake to post the order if the payment to the current account of SOLVE ET COAGULA OÜ has not been received.

 

3.2. Possibilities of delivery of goods within Estonia

3.2.1. Self pick-up – when the order is ready to be issued, a notification will be sent to the customer’s e-mail. The goods will be delivered from the official partner of Amanita e-store, Address: Haapsalu maantee 39, Pärnu, 80029 Pärnu county, Estonia (open EP 9:00 – 15:00).

3.2.2. Parcel machine – SmartPost machines are used to fulfill orders. parcel machines. Once the order has been forwarded to SmartPost, it should reach the customer in 2-14 days. SmartPost also delivers orders to vending machines on weekends. Upon arrival of the goods at the parcel machine, SmartPost notifies the customer by an SMS message. If the notification cannot be sent to the telephone number provided by the customer, it will be sent to the customer’s e-mail by SmartPost. Smartpost will deliver the parcel to the parcel machine of your choice. It is not possible to change the destination later.

3.2.2.1 If the Customer does not pick up the order at the SmartPost parcel machine during the storage period, the order will be returned to SOLVE ET COAGULA OÜ. In order to receive the order, the customer must pay SOLVE ET COAGULA OÜ the cost of returning and re-issuing the parcel according to the valid price list of SmartPost. Initial transport costs are not refundable under this item. 

3.2.3 Omniva post to a post office for a fee.

3.2.3.1 If the Customer does not pick up the order at the post office during the storage period, the order will be returned to SOLVE ET COAGULA OÜ. In order to receive the order, the customer must pay SOLVE ET COAGULA OÜ the cost of returning and re-issuing the parcel according to the valid price list of Omniva. Initial transport costs are not refundable under this item.

3.2.4 If the Customer does not pick up the order at the post office during the storage period, the order will be returned to SOLVE ET COAGULA OÜ. In order to receive the order, the customer must pay SOLVE ET COAGULA OÜ the cost of returning and re-issuing the parcel according to the valid price list of Omniva. Initial transport costs are not refundable under this item.

 

3.3 Possibilities to send products abroad:

3.3.1. Amanita does not send orders abroad.

3.5. Please make sure that the contact details are correct when entering your order. Amanita is not responsible for delays in the delivery of products due to inaccuracies or inaccuracies in the data entered. Amanita is also not responsible for the cost of returning the order if this is due to inaccurate or incorrect data.

 

3.6. If the product is out of stock, Amanita will notify the customer by e-mail or telephone as soon as possible, but not later than within 7 working days from the entry into force of the order.

 

3.7. Amanita is obliged to deliver the goods within 30 days at the latest. If the goods cannot be delivered, the customer will be informed by e-mail and the amount paid by the customer will be refunded immediately, but not later than within 30 days.

 

4. Procedure and consequences of contract cancelation

4.1. Cancelation procedure

4.1.1. The customer has the right to cancel this agreement within 14 days without giving a reason.

4.1.2. The withdrawal period expires 14 days after the day when the Customer or a third party specified by the Customer, who is not the carrier of the goods, has physically taken possession of the thing.

4.1.3. In order to exercise the right of withdrawal, the Customer must notify the contact details set out in clause 8 of the Amanita Conditions of his decision to withdraw from this agreement by an unambiguous statement (e.g., letter or e-mail). The customer can use the attached standard withdrawal form, but it is not mandatory (available here).

4.1.4. In order to comply with the term for exercising the right of withdrawal, it is sufficient if the Customer sends a notice regarding the exercise of the right of withdrawal before the expiry of the withdrawal period.

4.1.5 Due to the nature of the goods sold in the Amanita e-shop, the returned goods must be damaged (There must be no damage that was not caused by Amanita) and not opened in the case of sealed products. If these conditions are not met, the Customer loses the right of withdrawal. If Amanita has received the goods returned by the Customer, Amanita undertakes to return the amount paid (including postage) immediately, but not later than within 14 days.

4.2. Consequences of contract cancelation

4.2.1. If the Customer withdraws from this agreement, Amanita will refund to the Customer all payments received from the Customer, including delivery costs (except for additional costs arising from the Customer’s chosen delivery method other than the cheapest standard delivery method offered by Amanita) immediately, but no later than 14 days from the date Amanita will be informed of the Customer’s decision to withdraw from this agreement. Amanita will make such refunds using the same method of payment used by the Customer to make the payment, unless the Customer has expressly consented to the use of a different method of payment; in any case, the return of such payments to the Customer does not involve a service fee or other costs. Amanita may refuse to reimburse.  

4.2.2. In the event of withdrawal from the contract, the Customer undertakes to return the item or hand it over to Amanita immediately, but no later than 14 days after the day on which the Customer notifies Amanita of its withdrawal from the contract. The term is observed if the Customer returns the thing that is the subject of the contract before the end of the 14-day term. The costs of returning the thing must be covered by the Customer. The maximum return cost is approximately 10 euros.

4.2.3. Due to the nature of the goods sold in the Amanita e-store, the returned goods must be in the original packaging and unopened. If these conditions are not met, the Customer loses the right of withdrawal. If Amanita has received the goods returned by the Customer, Amanita undertakes to return the amount paid (including postage) immediately, but not later than within 14 days.

4.2.4. If the return of the goods is desired in cases where the goods are defective or do not correspond to the product ordered by the consumer, the return costs shall be borne by Amanita.

4.2.4.1 If the Customer wishes to return the order in part, the postage for sending the order will be refunded proportionally, according to the quantity of the goods from the entire order. For example, the customer ordered 3 items, and one of them wants to be returned, then 1/3 of the paid postage will be refunded together with the cost of the goods.

4.2.5. The seller is not responsible for the defects of the goods that have occurred in the event of improper use of the goods.

4.2.6. The customer has the right to rely on the legal remedies provided by law in the event of non-compliance with the terms of the contract.

 

5. Complaints

5.1. If the Customer does not return the goods within 14 days of receipt and the matter has become inconsistent with the terms of the contract, the reason for withdrawal must be provided in a written claim submitted to the contact details set out in clause 8.

5.2. In the event of a defect in the goods, Amanita shall be liable for non-compliance of the goods with the terms of the contract within two years from the delivery of the matter to the Customer. If the Customer does not notify the non-compliance of the thing with the terms of the contract in writing no later than within six (6) months after the non-compliance occurs, it is assumed that the defect did not exist at the time of delivery and the Customer must prove the existence of the defect at the time of delivery.

5.3. The complaint must state:

  •     Customer name and contact details.
  •     Date of complaint.
  •     Problem with goods.
  •     Requirement for e-shop.
  •     Attach a copy of the document / purchase receipt / payment confirmation confirming the completion of the transaction.

5.4. Amanita will respond to all complaints within 15 days. If it is not possible to reply to the complaint within 15 days, Amanita shall inform the consumer and set a new reasonable deadline for replying.

5.5. If Amanita rejects the consumer’s claim, he shall give reasons for the decision in writing to the consumer.

5.6. If the Goods do not comply with the terms of the contract, Amanita will replace the Goods with equivalent Goods. If the replacement of the Goods is not possible, the consumer has the right to withdraw from the contract and demand a refund.

5.7. In the event of a complaint, Amanita shall bear the costs of replacing the Goods during the first six months after delivery. For the next 1.5 years, Amanita will only bear the corresponding costs if the claim was justified.

5.8. In addition, the Consumer Customer has the right to apply to the Consumer Disputes Committee of the Consumer Protection Board to protect his or her rights. More detailed information on the procedure for submitting complaints can be obtained from the web address www.komisjon.ee.

5.9. The European Union’s online dispute resolution environment can be used to resolve cross-border disputes

 

6. Protection of personal data

6.1. Amanita processes personal data that has come to its knowledge only for the purpose intended for that purpose and does not disclose it to third parties, except in cases prescribed by law. See the Privacy Policy for more detailed terms and conditions for the processing of personal data.

8. Modification of Terms and Conditions and Pre-Contract Negotiations

8.1. Amanita reserves the right to change the Terms as needed. If you are a registered user, you will be notified of any changes to the Terms, and if you wish to use the Amanita Services, you must agree to the new Terms. If you do not agree to the new Terms, you will not be entitled to use the Amanita Services.

8.2. In the event of a dispute, the most recently updated Terms shall be deemed to apply.

8.3. These Terms, together with the Privacy Policy and third-party materials referenced in the Terms, constitute all terms of the Agreement, notwithstanding any other pre-contractual negotiations.

 

9. Availability of services and intellectual property

9.1. Amanita makes every effort to ensure that Amanita’s services are available in online environments, but sometimes this may not be possible (technical errors, interruptions, etc. may occur). Therefore, Amanita cannot and does not guarantee that online environments are always up and running.

9.2.  The Amanita trademark is not protected according to the legislation in force in Estonia. Any use of the trademark without the permission of its owner is not prohibited, even if the law provides otherwise.

9.3. The Web Environment as a whole, its individual components, and its source code are protected by the copyright of Amanita or others. In addition, photographs and other material displayed on the Web site that are protected by copyright or other intellectual property rights are not specifically indicated to be free material. The copying, distribution or other use of such materials for purposes other than personal use without the consent of the rights owner is prohibited, except as provided by law.

 

10. Differences in the application of the conditions to a legal person

10.1. Clauses 4, 5.1 ja 5.2. of these Terms and Conditions do not apply to the Client who is a legal person (together with sub-clauses). The parts to which these Terms and Conditions do not apply shall be based on the provisions of the law of Amanita and the legal entity Customer.

 

11. Jurisdiction and applicable law

11.1. The legislation of the Republic of Estonia applies to the conditions.

11.2. Disputes are first resolved through negotiations between the parties. If they fail, the Customer also has the right to apply to the Consumer Complaints Commission or the Harju County Court.

 

12. Promotional codes and gift cards

12.1. The discount code or gift card is a combination of letters and / or numbers, which, when entered at the checkout during the purchase process, makes the order more favourable by the corresponding discount.

12.2. The validity of a promotional code or gift card is determined by the appropriate communication at the place where the promotional code or gift card is distributed.

12.3. In the process of making an order (at the checkout), it is possible to choose which discount to use on the order – either a discount code, a gift card or amanitaeesti.ee bonus points. Only one of these three benefits can be used at a time.
